Qualifying for Social Security Disability Benefits in Washington

Not all government and state programs define “disabled” in the same way. For example, your condition may qualify for workers’ compensation, but not for Washington State disability benefits.

This makes the process of filing for these benefits all the more confusing for potential claimants.

As a rule of thumb, you are considered disabled under Social Security law if you’re incapable of performing your previous work due to a physical or mental condition that has lasted at least twelve consecutive months. It also takes into account your age, education, and previous work experience.

To determine if you fit the above description, the Social Security Administration uses a five-step evaluation of your condition. Here’s a quick summary of the steps:
STEP 1
Are you already working above SGA level?

SGA stands for “Substantial Gainful Activity,” and it refers to whether or not you’re already earning a certain amount of money. If you’re already earning more than $980 or $1640 per month, depending on your condition, you likely will not advance to step two.

STEP 2
How severe is your impairment?

You must have a medically determinable impairment or combination of impairments that interfere with basic activities and meet other specific criteria to be considered.

STEP 3
Is your impairment listed?

Your condition must meet the severity of one of the impairments already included in the Listing of Impairments laid out in Social Security regulations.

STEP 4
Can you continue your past work?

If you’re still able to perform at your “past relevant work,” you will not be considered disabled under Social Security law. This applies to the easiest job you’ve done in the last 15 years, even if the job no longer exists.

STEP 5
Can you make adjustments to perform any other work?

If you’re able to do another job, considering your age, education, experience, and impairment, you may not qualify for Social Security disability benefits.

The first four steps fall on the potential claimant to prove, and the last step must be proven by the Social Security Administration. Even if the Administration determines that you do have the capacity to work a different job, they will not help you find or be hired for the jobs that you are allegedly able to do.

Clearly, people in this position have to put up a fight in order to be acknowledged by the Social Security Administration. Without the help of an experienced Port Orchard Social Secutiry Disability attorney in your corner, it’s easy to get overwhelmed and lose out on life-changing benefits.
