This case arose from an incident in which a Quick and Clear, Inc. employee failed to properly secure a ladder on his truck.

The ladder flew off the truck on I-90 and landed in Mr. Powell's lane of travel. When he swerved to miss it he lost control of his vehicle and crashed.
