Domestic Violence Laws in Washington

Most of the laws that apply to domestic violence charges in Washington come from state laws as opposed to federal laws.

In R.C.W. § 7.105.010(9), Washington law defines domestic violence as when someone commits one of the following acts upon their intimate partner or family/household member:

Washington also allows victims of domestic violence to file for protection orders. There are two types:

  1. Ex parte temporary order for protection: These orders typically last for up to 14 days / until the court hearing for a final order for protection. The accused will not have notice of this hearing or be present for this hearing.
  2. Final order for protection: After a court hearing in which the accused and accusing parties both have a chance to tell their sides of the story, present evidence, witnesses, etc., the court can issue a final order for protection. This order for protection can be for a fixed period or permanent.

In addition to the potential for a protection order that bars the accused from contact with their intimate partner or family/household member, there are other serious consequences that come with a domestic violence conviction.

Plus, a judge can include in the protection order that the accused cannot contact his/her minor children (although this is subject to review after one year).

Finally, any domestic violence charge or issuance of a protective order can potentially result in revocation of your right to access firearms and entry of an order requiring that you surrender your firearms to law enforcement. Any domestic violence conviction will result in your gun rights being taken away, very likely forever.

Assault Defense Cases in Port Orchard, Washington

Assault charges can be classified as misdemeanors or felonies, depending on the circumstances of the case.

Generally, assault in Washington is defined as any unwanted physical and offensive contact. Assault can also be the threat of offensive contact and therefore does not need to result in an actual injury for charges to be brought.
