DUIs in Port Orchard, Washington

According to Washington State Statute RCW 46.61.50, Driving Under the Influence refers to a person driving a vehicle under the intoxicating influence of liquor, marijuana, or any drug.

Washington law enforcement officers identify indicators of intoxication as:

  • Having an alcohol concentration of 0.08 or higher according to a breath or blood test
  • Having a THC concentration of .5ng or higher according to a blood test
  • Having failed a Standardized Field Sobriety Test (e.g. a walk-and-turn test, a one-leg stand test, or a horizontal gaze test)

In some cases, you can be charged with a DUI at a lower blood alcohol concentration than 0.08. This is the case if you are driving a commercial vehicle, or if you are under the legal drinking age of 21, and sometimes simply based on the officer’s observations of your driving. Even if you are below 0.08 BAC, you can still be charged and convicted of DUI!

Additionally, police can arrest you purely on the basis of suspicious behavior, even if you haven’t consumed alcohol or drugs.

They may do this if they observe any of the following in your driving:

  • swerving,
  • driving without lights on,
  • failing to signal,
  • driving over or under the speed limit,
  • stopping inappropriately, or
  • driving in an otherwise “unusual” way

Penalties for DUI Charges in Port Orchard, Washington

In most cases, DUI charges in Washington are classified as gross misdemeanors. The sentences for DUI charges increase with every additional DUI arrest, if your blood alcohol content is over 0.15, or if someone was injured in the incident.

  • From one day (24 consecutive hours mandatory minimum) to one year in jail
  • Between $800 and $5,000 in fines
  • The installation of an ignition interlock device (IID) for a year or more

  • 90-day license suspension
Second offense DUI penalties:
  • From 30 days to one year in jail
  • Between $1,000 and $5,000 in fines
  • Electric home monitoring for 60-90 days
  • Five years of probation
  • Two-year license suspension
Third offense DUI penalties:
  • Between $1,800 and $5,000 in fines
  • From 90 days to one year in jail
  • The installation of an ignition interlock device (IID) for 10 years
  • Electric home monitoring for 120 days
  • Five years of probation
  • Three-year license suspension
